PLEASE READ THESE TERMS CAREFULLY BEFORE PURCHASING A COURSE OR OTHER SERVICES OFFERED BY DR. MC’S SELF-CARE CABARET, LLC (“DMCSCC”) VIA THE PODIA PLATFORM. THESE TERMS SET FORTH LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR USE OF THE SERVICES AND PARTICIPATION IN THE COURSES OFFERED BY DMCSCC.
Course Credentials. DMCSCC provides online unaccredited courses, programs, extended critique periods, or other products, services, and offerings in specific areas of study or on particular topics, or as otherwise offered through Podia.com (“Course(s)”). DMCSCC reserves the right to cancel, interrupt or reschedule any Course or modify its content as well any assignment, exercise, exam or other evaluation of progress that may be provided in connection with any Course. Courses are subject to these terms, the Podia Terms of Service and Privacy Policy, and any policies present on the DMCSCC website (“Collectively “Terms”). DMCSCC may offer a credential or other acknowledgment for participants who have satisfactorily demonstrated mastery of the Course material. These credentials, if granted, will be granted solely by DMCSCC. The decision to award any such credential or other acknowledgment to a given participant will be solely within the discretion of DMCSCC. DMCSCC makes no representations, warranties, or guarantees, concerning the recognition of such credential or acknowledgement by any third party. The format of any credential or other acknowledgment, and of any record of performance, provided by DMCSCC relating to the Courses will be determined by DMCSCC in its sole discretion and may vary from Course to Course.
Disclaimer. DMCSCC’s Courses are designed to give you consultative information with regard to the subject matter within DMCSCC’s expertise, mainly general advice and information about self-care, trauma recovery, and growth mindset and the DMCSCC proprietary methodologies. You understand and acknowledge that DMCSCC and its personnel are not medical doctors, psychiatrists, or psychologists. DMCSCC and its personnel are not providing customized one-on-one advice or information DMCSCC does not provide medical advice, diagnoses or treatment information, therapy or mental health counseling.
Non-Transferable. You may not transfer or sell your DMCSCC Courses to another party. If you are registering as a business entity, you personally guarantee that you have the authority to bind the entity to this Agreement.
Technology Requirements. The Courses are facilitated through an online systems. It is your responsibility to ensure that you have the proper hardware and software requirements, along with access to Wi-Fi, to be able to participate in the Courses. You will need to ensure you have the proper technology at the time of registration. DMCSCC is not be responsible for any errors or failures in relation to your ability to access the Course, the Podia Platform or any related materials, including where such errors or failures are caused by: (i) a loss of connection on DMCSCC’s or your end; (ii) a breakdown or problems with the online software and/or (iii) a breakdown or problems with your internet connection, computer or system.
Limited License. In consideration for your agreement to the Terms, DMCSCC grants you a personal, non-exclusive, non-transferable, revocable license to access and use the Courses solely in accordance with the Terms. DMCSCC may make DMCSCC Content (as defined below) available to you through the DMCSCC website, Podia Platform, Courses, or otherwise. You may obtain and use DMCSCC Content only for your own personal, non-commercial use in connection with your participation in the Courses. You may only copy and modify DMCSCC Content as necessary for your own personal, noncommercial use related to the applicable Course. You may not transfer, retransmit, distribute, publish, commercially exploit or create derivative works of DMCSCC Content. You may not record whether on video, audio tape, or other medium, relay by videophone or other means the Course. You may not reverse-engineer, decompile, disassemble or otherwise access the source code for any software that may be used to operate the DMCSCC website or to provide any Courses. Notwithstanding the foregoing, certain reference documents, digital textbooks, articles and other information may be made available to you as part of a Course with the permission of third parties, and use of that third party material may be subject to certain rules and conditions, which we will post along with the material or otherwise inform you about. You agree to abide by all such rules and conditions.
“DMCSCC Content” means all content or other material, in whole or in part, made available through the DMCSCC website, the Podia Platform, the Courses, or otherwise, by DMCSCC, including but not limited to lectures, speeches, discussions, comments, recordings, tutorials, workshops, video lessons, quizzes, tests, presentation materials, homework assignments, programs, code, and other images, text, layouts, arrangements, displays, illustrations, documents, materials, audio and video clips, podcasts, articles, blog posts, HTML and files. All DMCSCC Content is the property of DMCSCC and/or its affiliates or licensors and is protected by copyright, patent and/or other proprietary intellectual property rights under United States and foreign law.
Fees.
The Fees for each Course will be as set out on the DMCSCC website and/or the Podia Platform. Unless otherwise specified, the fees are exclusive of VAT or other local taxes. You are responsible for paying all fees and applicable taxes associated with purchasing and participating in Courses. You are responsible for reading the description of the applicable Course before making a purchase. Unless otherwise expressly agreed in writing by DMCSCC, full payment for participation in a Course is required at the time of registration. Specific payment requirements and related terms may be provided to you at the time of registration on the applicable Course-specific web page or otherwise on the applicable Service. You are responsible for non-payment, even if the fee is being paid by a third party. Any fees charged by your bank, debit or credit card provider in connection with your purchase of any Courses or services are for your own account and DMCSCC shall not be responsible for these. You shall be responsible for all costs you incur in connection with your attendance at and access to any Courses. FEES ARE NON-REFUNDABLE.
Your purchase of any Course(s) is subject to the limited license rights specified Section 5 herein. You agree not to violate the terms of such license and further that purchase of the Course(s) does not provide you with any license to copy, distribute, commercialize, provide to friends, family, colleagues, post online, or otherwise make available to third parties, the Course(s).
Upon purchase of Course(s), which are available via streaming on the Podia Platform, you will have access to such Course(s) for a period of three hundred and sixty-five days (365). Upon the 365th day anniversary of your purchase, your access to the Course(s) will expire. Your access to such Course(s) may cease due to removal of the Course(s) by DMCSCC. DMCSCC cannot restore access to, or provide copies of, purchased Course(s) that has been removed from our Website.
DMCSCC allows you to register for and participate in Courses via the Podia Platform. Podia is a platform that allows for the administration of and participation in curriculum, including live participation via video and audio. You understand and acknowledge that DMCSCC does not have control over Podia, its terms of use, its privacy policies, or security. Please review Podia’s legal policies prior to using Podia.
DMCSCC's Intellectual Property.
DMCSCC, and other DMCSCC graphics, logos, designs, page headers, button icons, scripts, and service names are copyrights, registered trademarks, trademarks or trade dress of DMCSCC, Inc. in the U.S. and/or other countries. DMCSCC's trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names or email addresses, in connection with any product or service in any manner that is likely to cause confusion to consumers or in any manner that disparages or discredits DMCSCC. All other trademarks not owned by DMCSCC that appear on this Website are the property of their respective owners.
You acknowledge and agree that any DMCSCC Content, including but not limited to text, data, photos, graphics, etc. or other material contained or distributed on or through the DMCSCC website and/or Podia Platform, by DMCSCC, its advertisers or other third parties, is protected by trademarks, service marks, patents, copyrights, or other proprietary rights and laws. You may not use or distribute any DMCSCC Content without the authorization of DMCSCC. You agree not to publish, reproduce, copy, in whole or in part, nor upload, download, post, email, sell, or otherwise distribute DMCSCC Content, in violation of applicable copyright and other intellectual property laws.
